We are so proud of what the NCBA YLD has accomplished in the first half of this year and what is in the works for the rest of the year. We are also beginning the process of planning for the 2019-20 bar year and we need your input. This year, the YLD Wellness Committee instituted a Wellness Challenge between the Mountain, Piedmont, and Coastal regions of the state. Each quarter, the attorneys in their respective regions will be highlighted for their efforts to engage in wellness activities such as physical and financial fitness, nutrition, mindfulness, and meditation. This quarter we are shining a spotlight on the Mountain region, which includes Charlotte. Next up will be the Piedmont region — Raleigh, Greensboro, and the surrounding areas — from January 2019 through March 2019. Then, the Coastal Region — Wilmington, Elizabeth City, and the surrounding areas — will participate in the challenge from April 2019 through July 2019. The region with the most engagement receives a free networking event sponsored by the NCBA YLD. Follow the challenge on Twitter at #YLDWellness.

Business, industry, law, and relationships straddle our oceans more often than not in a world increasingly connected through technology. It is imperative, then, for many young lawyers of the North Carolina Bar Association to build international relationships with attorneys outside of the United States. In an effort to foster these relationships, the NCBA Young Lawyers Division, in partnership with the International Law & Practice Section of the NCBA, will host five fellow young lawyers from Haiti the week of Sept. 10-15.
Rule 30(b)(6) of the Federal Rules of Civil Procedure, along with analogous rules under state law, provides a tremendous discovery tool for litigators. Unlike the depositions of named witnesses, depositions under Rule 30(b)(6) require that an organization designate and prepare an individual to testify as to all delineated information “known or reasonably available to the organization” – not merely information personally known to the deponent – and offer testimony that is binding on the organization. When used properly, 30(b)(6) depositions can render “I don’t know” answers a rarity, while offering an incredibly effective mechanism for fact-finding and efficiently progressing the underlying litigation. This article is designed to provide a general overview of the 30(b)(6) device, as well as offer insight as to the duties of counsel when proceeding under Rule 30(b)(6), and the distinctions between a 30(b)(6) deposition and a deposition of a named witness.[1]
