Responsibility under FIRPTA is often misunderstood. Although the seller owes the tax, the buyer is responsible for ensuring compliance, and the closing team typically manages the process. If it’s handled incorrectly, the buyer may be exposed to penalties and interest starting at roughly 5.5% of the withholding amount in the first month.
Nena shares the importance of asking about residency status upfront, addressing FIRPTA early, coordinating with all parties and bringing in a specialist when needed.
