Two upcoming North Carolina Bar Foundation pro bono events give us the opportunity to share the wealth of family law knowledge and experience that our section has to offer. The North Carolina Bar Association Elder & Special Needs Law Section (NCBA – EL) recognizes that although the public perceives lawyers to be among the most affluent members of society, in fact, many attorneys struggle to make ends meet, need to pay off large amounts of law school debt, or sometimes suffer from economic hardship due to the poor job market, disabilities or other factors. The NCBA –EL wants membership in, and services from, the section to be available to attorneys regardless of their ability to pay. We understand that one of the greatest services available for members is the high quality continuing legal education through the North Carolina Bar Association. As a result, the NCBA – EL has established a scholarship program for CLE program tuition for the NCBA – EL 25th Annual Elder & Special Needs Law Symposium on March 4, 2021 and March 5, 2021. In Skye Mineral Investors, LLC and Clarity Copper, LLC v. DXS Capital (U.S.) Limited et al., C.A. No. 2018-0059-JRS (Del. Ch. Feb. 24, 2020), the Delaware Court of Chancery rejected a motion to dismiss breach of fiduciary duty claims brought against two minority members of Sky Mineral Partners, LLC (“SMP”), a Delaware limited liability company, stemming from their exercise of certain veto or “blocking” rights they had under SMP’s limited liability company agreement (the “LLC Agreement”).

Each year our Nominations Committee takes nominations for new council members and a slate of officers for the council. Council membership requires membership in the NCBA and the Labor & Employment Section, attendance at four council meetings scheduled around the state each year, and willingness to serve a three-year term.
We are also looking for folks interested in serving on the section’s committees. Council seats are limited, but there is no lack of committee opportunities. It’s a terrific opportunity to get involved and help grow the section.

We all have that one mentor whose guidance has been invaluable to our professional advancement or simply an individual who we have admired from afar, and we all like to have our efforts recognized. Now is the time to acknowledge that person. We are now accepting nominations for the North Carolina Bar Association Administrative Law Award for Excellence.
This award was established in 2017 by the Administrative Law Section Council to honor an attorney:
(a) who has practiced administrative or regulatory law for at least ten years and who has continuous experience in this practice;
(b) who is a member of the North Carolina Bar Association and the Administrative Law Section;
(c) who has an exemplary record and reputation in the legal community and follows the highest ethical standards;
(d) who has an exemplary record of active participation in the efforts to improve the administrative and regulatory process for regulators, the regulated public, the citizens of North Carolina and in the interests of justice.
Please note that award nominees must be residents of the state of North Carolina and must also be nominated by a member in good standing of the North Carolina Bar Association.

Every first Friday of May, the American Bar Association hosts Law Day to celebrate the role of law in our society and to cultivate a deeper understanding of the legal profession. Law Day 2021 will focus on “reminding us that we the people share the responsibility to promote the rule of law, defend liberty, and pursue justice.” During the North Carolina Bar Association’s Law Week, the Liberty Bell Committee hosts several competitions to recognize students and legal professionals throughout the state who have dedicated their time to pursuing justice and being a voice for all. The committee is excited to announce that it will be hosting this year’s Law Day celebration on Friday, May 7, 2021. Please see a list of competitions for students and legal professionals below.
