As a reminder, the format is

  1. We will post a number of multiple choice questions related to a monthly family law theme. These will be “specialist-level” questions. We will also give you the answers!
  2. We will post a specialist-level fact pattern. Do your best to answer it, either in your head or on paper. Please make it electronic paper and save some trees. We will then post the answers.
  3. In the next blog post, we’ll show you the anonymous results of the multiple choice section, if we get enough people to respond.

  • Father and Mother separate and divorce.
  • After a couple of years of peaceful co-parenting, Mother begins making allegations that Father is sexually abusing the children.
  • After a lengthy trial, the court determines that Father has not sexually abused the children, and, in fact, Mother is the one who has abused the children by convincing them that they had been abused when they had not.
  • The trial court entered a permanent custody order which required Mother to have no visitation, attend therapy, and that Mother could not have visitation until she came to believe that she was wrong and that Father had not abused the children.
  • Mother has complied in attending therapy, and her therapist states that she has been compliant in attending but has not changed her beliefs.
  • Did the Court abuse its discretion when fashioning Mother’s therapy framework, or was this an acceptable term to be met prior to visitation commencing?
